AIRPORT LUGGAGE STORAGE
Storage agreement terms and limitations of liability
1. Deposit Contract. The ticket/receipt together with this Clause are integral parts of the custody relationship for luggage and suitcases delivered by the Depositor to the consignee company Precintados Alicante 21 S.L. (hereinafter PV21). Through this consent, both parties assume the capacity to contract and accept the conditions of use of the service.
2. Price of the Service. PV21 undertakes to diligently safeguard the objects placed in its charge in consideration for the price and charges of its services. The Depositor may consult the prices, weight capacities and measurements in the PV21 store and Consigna or at www.consignaalicante.com
3. Withdrawal of what was deposited. It is custom and commercial use regarding what is left in deposit, that the User of the service (who delivers and the one who withdraws what was consigned), may not be the same person or the owner of the object, so the ticket/receipt constitutes both proof of receipt of the deposit and the accreditation element for the return of what was consigned to the bearer of the same. In case of loss or misplacement of the ticket/receipt, the report filed with the Police must be provided, in the recorded description of the items. Failing that, the Claimant will sufficiently justify the ownership or authorization for the deposit. Once the right to the object has been proven, the deposit will be delivered after completing the corresponding declaration and settling the accrual for the services and extraordinary costs generated. PV21 is released from the duty of care and custody by delivering the deposit to the bearer of the ticket/receipt or to the Claimant. In any case, if after withdrawing the deposit the affected Premises is abandoned without opposing or claiming anything, PV21 is exonerated from all responsibility. In this sense, it is the User's full responsibility to review the items at the time of their withdrawal.
4. Duty of the Depositary. PV21 only undertakes to safeguard what is left in deposit without making any other use, unless expressly authorized or due to mandatory legal situations.
5. Maximum deposit value. PV21 will not guard objects worth more than €200, and it is the sole responsibility of the Depositor to deliver objects worth more than €200. Any appraisal that may be carried out will always be the responsibility of the Depositor.
6. Assurance. PV21 insures its liability for any damage that may occur to the consigned items up to a maximum amount of €200. Furthermore, the following are excluded from insurance and liability of PV21, and remain under the responsibility of the Depositor: fines and sanctions imposed by public and judicial administrations related to belongings or those carrying them, damages and losses suffered by aircraft, by equipment for loading and unloading passengers and luggage, by X-ray devices and ionizing radiation, by toxic, infectious or dangerous elements, by those derived from tissues, cells, organs or any organic elements. biosynthetics or that derive from or have any type of interrelation with the acquired immunodeficiency syndrome, for damages caused or derived by pollution, contamination, vibrations, noise, waves, radiation, electromagnetic or environmental fields, for tobacco and derivatives, for goods formed by union, mixture or integration of products of the Depositor, and for situations of defense, war, invasion, terrorism, violent acts or similar conflicts, rejection, confiscations or expropriations or of objects prohibited, restricted or limited in the contract.
7. Prohibitions, restrictions and limitations on deposits.

7.2 Prohibited or restricted deposits. The Depositor will refrain from delivering in deposit a) money and products or negotiable financial instruments b) works of art, antiques, precious stones and other valuable objects c) fragile items d) products without adequate packaging) nor objects classified as dangerous specifically by the airport authorities, (such as containers or sprays with gas, flammable liquids or products, corrosive products, chemical, toxic and infectious substances, explosive products or susceptible to assimilated reactive or radioactive events) f) animals, plants or foodstuffs or other perishables prohibited within the European Union g) firearms or other types of weapons and devices that fire projectiles, sharp or sharp objects or other tools that can cause serious injuries, h) stolen or illicitly trafficked items, i) any others that constitute a criminal or administrative offense or that the airport and security authorities include within their restrictions. In the event that products that are not allowed, restricted or excluded are detected, PV21 reserves the right to reject them at any time and, where appropriate, inform the private surveillance services and the relevant public authorities without consulting the Client. If expenses or charges of any kind arise from the withdrawal or disposal of such products, they will be transferred to the Depositor plus a charge of €100. In any case, the Client will not have the right to compensation or claim of any kind and PV21 will not be obliged to return or send the items in question and will be released from any type of liability for this.
8. Access to deposited objects. Once the luggage and belongings are delivered to the deposit, the Depositor will not be allowed access to any deposited object, unless he proceeds through payment for the service to fully rescue what was left in custody.
9. Claims. In case of loss, wrong delivery, non-return or damage to what was deposited, the Depositor must prove that such an event has occurred and that it was caused under the relationship of deposit and responsibility of PV21.
10. Right of retention. If the Depositor accrues or owes any amounts affected or derived from the relationship, PV21 will reserve the right to withhold the deposit until its complete payment.
11. Maximum duration of the contract. The maximum term, per deposit contract, is ninety (90) calendar days from the date of receipt of the movable property by PV21.
12. Abandonment of the deposit. The Depositor will have abandoned the deposit if he has not proceeded to pay and withdraw the deposit before ninety (90) days of contract duration. After the term, PV21 may liquidate the items for sale, auction, barter or donate them to charity. If any product is obtained through the liquidation, it will be applied to the payment of what is owed.
13. General Conditioning. PV21 reserves the right to make any modifications to the General Conditions that it deems appropriate without prior notice. This condition will be set out in the PV21 Instructions and, in any case, will be available to the Depositor and other users.

The personal data collected due to the relationship will be processed by PV21 or transferred to third parties in charge or its group, for the purposes of managing legal, user, accounting, tax, administrative and contractual guarantees in accordance with the regulations on Data Protection applicable in Spain (Law 15/1999, of December 13), with the User being able to access and update their data or show their opposition, cancellation or revocation, without prejudice to maintaining the necessary elements of the contract or criminal obligations. To this end, you may contact us in writing or by email at info@consignaalicante.com, indicating “Personal Data” in the subject line.
15. Conflict Resolution. All deposits are accepted in accordance with the regulations applicable in Spain and the parties renounce their own jurisdiction, submitting to the Courts and Tribunals of the territorial jurisdiction of the Alicante-Elche Airport, and in any case, to those of Alicante (Spain).
