Terms and Conditions of the Deposit Agreement and Limitations of Liability

1. Deposit Contract. The ticket/receipt together with this Clause are integral parts of the custody relationship of luggage and bags delivered by the Depositor to the signatory company Precintados Alicante 21 S.L. (hereinafter PV21). By means of this consent both parts assume the capacity to contract and accept the conditions of use of the service.

2. Price of the Service. PV21 undertakes to diligently store the objects placed in its charge in consideration of the price and charges for its services. The Depositor may consult the prices, weight capacities and measurements at PV21's store and Consignment or at www.consignaalicante.com.

3. Withdrawal of what is deposited. It is customary and commercial use with respect to what is left in deposit, that the User of the service (who delivers as the one who withdraws the consigned), may not be the same person or the owner of the object, so that the ticket/receipt constitutes both the proof of receipt of the deposit and the accrediting element for the return of the consigned to the bearer of the same. In case of loss or misplacement of the ticket/receipt, the report filed with the Police, containing a description of the items, must be provided. Failing this, the Claimant shall provide sufficient proof of ownership or authorization for the deposit. Once the right to the object has been proven, the deposited goods will be delivered to the Claimant after completing the corresponding declaration and settling the charges for the services and extraordinary costs generated. PV21 is released from the duty of safekeeping and custody by delivering the deposited item to the bearer of the ticket/receipt or to the Claimant. In any case, if after the withdrawal of the deposited items, the affected Premises are abandoned without any objection or claim, PV21 is exonerated from any liability. In this regard, it is the full responsibility of the User to check the items at the time of their withdrawal.

4. Duty of the Depositary. PV21 only undertakes to take custody of what is left in deposit without making any other use, unless expressly authorized or due to legal situations of obligatory compliance.

5. Maximum value of the deposit. PV21 will not take custody of objects with a value of more than 200€, being the Depositor's sole responsibility to deliver objects with a higher value. Any appraisal that may be required will always be at the Depositor's expense.

6. Insurance. PV21 insures its liability for possible damages that may occur to the consigned items up to the maximum amount of 200€. Furthermore, the Depositor is excluded from PV21's insurance and liability, being the Depositor's responsibility: fines and penalties imposed by public and judicial administrations related to the belongings or those who carry them, damages suffered by aircraft, by loading and unloading equipment for passengers and luggage, by X-Ray and ionizing radiation equipment, by toxic, infectious or dangerous elements, by those derived from tissues, cells, organs or any biosynthetic organic elements or which derive from or have any type of interrelation with the acquired immunodeficiency syndrome, for damages caused by or derived from pollution, contamination, vibrations, noises, waves, radiations, electromagnetic or environmental fields, for tobacco and derivatives, for goods formed by union, mixture or integration of the Depositor's products, and for situations of defense, war, invasion, terrorism, violent acts or similar conflicts, rejection, confiscations or expropriations or of objects prohibited, restricted or limited in the contract.

7. Prohibitions, restrictions and limitations on the deposit.

7.1 Lawful deposit. The Depositor shall in no case deliver stolen, stolen or illicitly trafficked objects and shall assume all responsibility for the diligence and legal observance (especially that required in air traffic) on control of luggage and belongings as well as the avoidance of any manipulation by third parties.

7.2 Prohibited or Restricted Deposits. Depositor shall refrain from delivering in deposit a) money and negotiable financial products or instruments b) works of art, antiques, precious stones and other valuables c) fragile items d) products without adequate packaging) nor objects specifically classified as dangerous by the airport authorities, (such as containers or sprays with gas, flammable liquids or products, corrosive products, chemical, toxic and infectious substances, explosive products or products susceptible to assimilated reactive events, f) animals, plants or foodstuffs or other perishables prohibited within the European Union g) firearms or other weapons and devices firing projectiles, sharp or edged objects or other tools likely to cause serious injury, h) stolen or illicitly trafficked goods, i) any other items that constitute criminal or administrative offences or that the airport and security authorities include within their restrictions. In the event of detection of products that are not permitted, restricted or excluded, PV21 reserves the right to refuse them at any time and, if necessary, to inform the private security services and the relevant public authorities without consulting the Customer. If expenses or charges of any kind are incurred for the removal or disposal of such products, they will be passed on to the Depositor plus a charge of 100€. In any case, the Customer shall not be entitled to any compensation or claim whatsoever and PV21 shall not be obliged to return or send back the items in question and shall be released from any liability whatsoever for this.

8. Access to deposited objects. Once the luggage and belongings have been deposited, the Depositor shall not be allowed access to any deposited object, unless the Depositor proceeds by payment of the service to the total rescue of what is left in custody.

9. Claims. In case of loss, wrong delivery, non-return or damage on the deposited goods, the Depositor will have to prove that such an event has occurred and that it was caused under the deposit relationship and responsibility of PV21.

10. Right of retention. If the Depositor accrues or owes any amounts due or arising from the relationship, PV21 reserves the right to withhold the deposit until full payment is made.

11. Maximum term of the contract. The maximum term, per deposit contract, is ninety (90) calendar days from the date of receipt of the movable goods by PV21.

12. Abandonment of the deposit. The Depositor will have abandoned the deposit if he/she has not proceeded to the payment and withdrawal of the deposited items before the ninety (90) days of the term of the contract. Once the term has elapsed, PV21 may liquidate the items for sale, auction, barter or donate them to charity. If any proceeds are obtained from the liquidation, they will be applied to the payment of what is due.

13. General Conditions. PV21 reserves the right to make any modifications to the General Conditions it deems appropriate without prior notice. These terms and conditions will be displayed at PV21's Consignments and in any case, at the disposal of the Depositor and other users.

14. Data Protection. The personal data collected as a result of the relationship will be treated by PV21 or transferred to third parties in charge or of its group, for the purposes of legal guarantee management, users, accounting, tax, administrative and contractual purposes in accordance with the regulations on Data Protection applicable in Spain (Law 15/1999, of December 13), and the User may access and update their data or show their opposition, cancellation or revocation, without prejudice to maintaining the necessary elements of the contract or criminal obligations. 15. Dispute Resolution. All deposits are accepted in accordance with the applicable regulations in Spain and the parties waive their own jurisdiction, submitting themselves to the Courts and Tribunals of the territorial jurisdiction of Alicante-Elche Airport, and in any case, to those of Alicante (Spain).
